How to Appeal a ZUS Decision (Odwołanie): Deadline, Court and Template
A refused sickness benefit, a pension calculation you disagree with, or a contribution decision: here is how foreigners appeal ZUS decisions, without fees and without a lawyer.
1 monthfrom delivery of the decision to file the appeal
0 złcourt fee for the insured person
30 daysfor ZUS to change its decision or send the case to court
How the appeal works
An appeal (odwołanie) against a ZUS decision goes to the labour and social insurance court, but you file it through the ZUS unit that issued the decision (Code of Civil Procedure, art. 4779). The decision itself names the court and the deadline in its instruction (pouczenie).
ZUS first reviews the appeal. If it agrees with you, it changes or cancels its decision. If not, it forwards the appeal with the case file to the court within 30 days.
Deadline
You have one month from the day you received the decision. Keep the envelope or the ePUAP/PUE ZUS receipt that shows the date. If ZUS does not issue a decision within 2 months of your request, you can also appeal against its inaction.
A late appeal can be accepted by the court if the delay is not excessive and not your fault, but do not rely on it.
What to write
Your name, PESEL (or passport number), address and contact details.
The decision you appeal: its number and date.
What you want: change the decision and grant the benefit, or recalculate.
Why: the facts and documents ZUS missed (e.g. contracts, medical records, A1 or foreign insurance periods).
Your signature and the list of attachments.
Write in Polish: the language of court proceedings is Polish. You can file on paper at any ZUS branch, by registered post, or electronically through PUE/eZUS.
Costs and representation
An insured person does not pay a court fee in social-insurance cases. You can represent yourself; a lawyer is optional. If you cannot afford one, you can ask the court for a court-appointed lawyer. Foreign periods of insurance in the EU or in countries with a social-security agreement can change the outcome, so attach any proof you have.
Common reasons ZUS refuses
Sickness benefit refused because the 30-day waiting period was not completed (see our L4 guide).
Doubts about the employment contract being genuine (e.g. high salary shortly before maternity).
Missing foreign insurance periods in a pension calculation (see ZUS pension guide).
